Article 1 – Identity of the entrepreneur

Article 2 – Applicability
- These general terms and conditions apply to every offer from POOT. and to every agreement concluded via the website.
- The agreement is concluded with a consumer as referred to in Article 6:230g of the Dutch Civil Code.
- Deviations are only valid if agreed upon in writing.
Article 3 – The offer
- Product descriptions are displayed as accurately as possible.
- Images are illustrative; slight color or size differences do not constitute grounds for dissolution.
- Obvious errors or mistakes do not bind POOT.
Article 4 – Formation of the agreement
- The agreement is concluded after the consumer has fully completed the order and received an order confirmation.
- POOT. reserves the right to refuse an order in case of:
- suspected fraud
- misuse
- incorrect payment details
- obvious pricing errors
Article 5 – Prices and payment
- All prices include VAT and exclude shipping costs, unless stated otherwise.
- Payment must be made in advance using the payment methods offered.
- POOT. reserves the right to change prices.
Article 6 – Delivery and risk
- POOT. ships orders from the Netherlands.
- The stated delivery times are indicative.
- The risk of damage or loss rests with POOT. until the moment of delivery to the consumer.
- If a package is demonstrably damaged upon receipt, the consumer must report this immediately upon delivery and report it in writing with photos within 48 hours.
Article 7 – Right of withdrawal (14 days)
- The consumer has the right to dissolve the agreement within 14 days without giving reasons.
- The reflection period starts the day after receipt of the product.
- During the reflection period, the consumer must handle the product with care.
Article 8 – Return conditions
- Returns must be reported within 14 days of receipt via info@pootstudio.nl
- After notification, the product must be returned within 14 days.
The product must be:
- Not used other than for assessment
- Free of pet hair, odors or signs of use
If the product has been used more than necessary to assess it, a reduction in value may be charged.
Return costs are for the account of the consumer.
POOT. will refund the purchase amount including original shipping costs within 14 days of receiving the return shipment.
Article 9 – Exclusion of the right of withdrawal
The right of withdrawal is excluded for:
- Products that cannot be returned for hygiene reasons and whose seal has been broken
- Products visibly used by pets
- Custom-made products (if applicable in the future)
Article 10 – Conformity and warranty
- POOT. guarantees that products comply with the agreement.
- The statutory warranty applies.
- Warranty expires if:
- Damage has occurred due to improper use
- The product has not been used according to instructions
- Normal wear and tear occurs
- Damage occurs due to intensive use by animals
Article 11 – Liability
- POOT. is not liable for indirect damage, including consequential damage.
- Liability is limited to the purchase amount of the product concerned.
- POOT. is not liable for:
- Damage to pets
- Injury due to incorrect use
- Allergic reactions
- Damage caused by intensive chewing, scratching or biting
- Products are consumables for animals and not indestructible objects.
Article 12 – Claims and reporting obligation
- Any defects must be reported in writing within a reasonable period after discovery.
- The consumer must enable POOT. to investigate the defect.
- Unjustified claims may be rejected.
Article 13 – Force majeure
- POOT. is not liable for delay or non-performance due to circumstances beyond its control, including:
- Transport problems
- Strikes
- Government measures
- Natural disasters
Article 14 – Intellectual property
- All texts, designs, logos and images are the property of POOT. and may not be used without permission.
- Article 15 – Applicable law

Dutch law applies to all agreements.

Disputes will be submitted to the competent court in the Netherlands.
